The Pantagraph.com is reporting that Dylan Baerwald, 25, of Bloomington, died Thursday afternoon when the car he was a passenger in collided with a tree. The driver of that car, Brenton Fenwick, 24, also Bloomington, has been charged with reckless homicide, DUI, and leaving the scene of an accident. His bail was set today at $500,000.
Police say the accident occurred on County Road N 1000 E at Illinois 9. Fenwick blew through the intersection, failing to observe the stop sign. His car ran off the road and struck a tree. At one point his vehicle became airborne.
According to the Pantagraph, Fenwick’s BAC registered .043. The news outlet says the legal limit in Illinois is .08. It may be that the correct BAC was .43 since Fenwick was charged with DUI.
The McLean County Sheriff’s Department has some video showing Fenwick’s erratic driving, tape that contradict’s his assertion that he ran off the road to avoid another vehicle.
Baerwald was declared deceased at 2:49 AM on Thursday at the hospital,
Fenwick’s arraignment is set for May 25th.
